By creating an account or using Shoup ("the Platform"), operated by The Buddi Brand Inc. dba Shoup ("Shoup," "we," "us"), you agree to these Terms of Service. If you do not agree, do not use the Platform.
You must be at least 18 years old and able to form a binding contract to use Shoup. By using the Platform you represent that you meet these requirements.
Shoup is a platform that connects people navigating perimenopause and menopause ("Shoupers") with wellness and healthcare practitioners ("Providers"), and with community, resources, and events. Shoup is not a healthcare provider. We do not practice medicine, provide medical advice, diagnose conditions, or prescribe treatment. Content on the Platform, including posts by Providers and other members, is for informational and community purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions about a medical condition. Never disregard professional medical advice or delay seeking it because of something you read on Shoup. If you are experiencing a medical emergency, call your local emergency number immediately.
You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You are responsible for activity under your account. Notify us promptly of any unauthorized use.
You agree not to: harass, abuse, or harm other members; impersonate any person or entity; post false, misleading, or unlawful content; present yourself as a licensed provider when you are not; offer medical advice you are not qualified to give; or share another person's private or identifying information without consent. We may remove content or suspend accounts that violate these rules.
Shoup includes community spaces where you may choose to share personal experiences, including health-related information. Anything you post in the community may be visible to other members according to the audience settings available to you. You are responsible for what you choose to share about yourself, and you should not post information you would not want visible to the community. Sharing personal or health information is voluntary and at your own discretion. Consider carefully before posting sensitive details, and use any available privacy or audience controls to manage who can see your content.
Providers are independent and solely responsible for their own credentials, licensure, qualifications, and the services they offer. Shoup does not employ, supervise, or guarantee any Provider. Any vetting or verification we perform is limited and does not constitute an endorsement or a guarantee of a Provider's competence, licensure, or the outcome of any service. Any agreement for services is strictly between the Shouper and the Provider.
You retain ownership of the content you post. By posting, you grant Shoup a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content on and in connection with the Platform. You are responsible for the content you post and represent that you have the right to post it. We may remove any content at our discretion.
Paid subscriptions and credits are billed through our payment processor, Stripe. By subscribing, you authorize recurring charges according to the plan you select until you cancel. You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing cycle, and you will retain access until then. We do not provide refunds for partial billing periods or unused time, unless otherwise agreed to in writing. Credit packs are non-refundable once purchased. Prices may change with notice.
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. To the fullest extent permitted by law, Shoup and The Buddi Brand Inc. will not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform or from any interaction with a Provider or other member.
You may stop using the Platform and close your account at any time. We may suspend or terminate your access if you violate these Terms or for any lawful reason. Provisions that by their nature should survive termination will survive.
We may update these Terms from time to time. Material changes will be communicated through the Platform. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
